FamilyView Terms of Service
Effective Date: January 31, 2025
Welcome to FamilyView! These Terms of Service ("Terms") govern your use of the FamilyView application ("App") and related services provided by Santiago Innovations LLC ("we," "us," or "our").
By downloading, installing, or using FamilyView, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By accessing or using FamilyView, you confirm that:
- You are at least 18 years old, or have parental/guardian consent to use the App
- You have the legal capacity to enter into a binding agreement
- You will use the App in compliance with all applicable laws and regulations
2. Description of Service
FamilyView is a video calling application designed for families, enabling:
- Video calls between Samsung Smart TVs and mobile devices
- TV-to-TV, phone-to-phone, and cross-device video calling
- Baby monitor functionality
- Family group management
- Real-time presence status
3. Account Registration
3.1 Account Creation
To use FamilyView, you must create an account by providing:
- Valid email address
- First and last name
- Secure password
3.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Acceptable Use
4.1 Permitted Uses
You may use FamilyView for:
- Personal, non-commercial video calling with family members
- Monitoring children within your household (baby monitor feature)
- Managing your family group connections
4.2 Prohibited Uses
You agree NOT to:
- Use the App for any illegal, harmful, or fraudulent purpose
- Harass, threaten, or abuse other users
- Transmit any content that is obscene, defamatory, or violates others' rights
- Attempt to gain unauthorized access to other accounts or systems
- Use the App to monitor individuals without their consent (except minor children under your guardianship)
- Reverse engineer, decompile, or attempt to extract source code
- Use the App in any way that could damage, disable, or impair our servers
- Resell or commercialize the App or its features
Important: The baby monitor feature is intended ONLY for monitoring your own children within your household. Using this feature to monitor others without consent is prohibited and may be illegal.
5. Family Groups
5.1 Creating and Managing Groups
When you create a family group:
- You become the group administrator
- You can invite other users to join your family
- You are responsible for who you invite
5.2 Joining Groups
When you join a family group:
- Your name and online status will be visible to other group members
- Other members can initiate calls with you
- You can leave a group at any time
6. Privacy and Data
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key points:
- We do NOT record or store video call content
- Video streams are encrypted end-to-end when possible
- We collect only the data necessary to provide the service
7. Intellectual Property
All content, features, and functionality of FamilyView, including but not limited to text, graphics, logos, and software, are owned by Santiago Innovations LLC and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8. Disclaimers
8.1 Service Availability
FamilyView is provided "as is" and "as available." We do not guarantee:
- Uninterrupted or error-free service
- That the App will meet all your requirements
- The accuracy or reliability of any information obtained through the App
8.2 Third-Party Services
FamilyView may integrate with third-party services (e.g., Samsung Account, STUN/TURN servers). We are not responsible for the availability or performance of these third-party services.
9. Limitation of Liability
To the maximum extent permitted by law, Santiago Innovations LLC shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any damages resulting from unauthorized access to your account
- Any damages resulting from service interruptions or failures
10. Indemnification
You agree to indemnify and hold harmless Santiago Innovations LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
11. Termination
11.1 By You
You may stop using FamilyView and delete your account at any time by contacting us.
11.2 By Us
We may suspend or terminate your access to FamilyView at any time, without prior notice, for:
- Violation of these Terms
- Conduct that we believe is harmful to other users or our business
- Extended periods of inactivity
- Any other reason at our sole discretion
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Effective Date" at the top
- Sending an email notification for significant changes
Your continued use of FamilyView after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of FamilyView shall be resolved through:
- Informal Resolution: First, contact us to attempt to resolve the dispute informally
- Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Santiago Innovations LLC regarding FamilyView and supersede any prior agreements.
17. Contact Us
